HB 4037: Individual Income Tax; Credit; Education (Died)

  • Sponsor: Rep. Michele Peña (Daily Independent)
  • Status: Introduced February 5, 2026. The House Ways and Means Committee recommended it as amended, and House Rules found it constitutional and proper. It was held in the House Committee of the Whole and did not pass (Arizona Legislature: HB 4037).
  • On a committee agenda: Yes (House Ways and Means; House Rules)
  • Synopsis: Would have created a refundable “education opportunity tax credit” for families educating children outside public school without ESA funds, including homeschool affidavit filers. The credit would have been tied to base per-pupil funding (Daily Independent). Arizona Families for Home Education opposed it, warning that taxpayer funding tied to homeschooling would invite regulation. AFHE testified in committee (AFHE).
  • Rating: 👍👎 Mixed. The credit would have put money back in some families’ pockets. However, the state homeschool organization warned it could make Arizona’s privately funded homeschool option a target for oversight.
